New York Health Care Reform Act

If your company offers a self-funded health plan from Blue Cross Blue Shield of North Dakota and any employees receive medical care in the state of New York, you may be subject to state fees to help fund public health programs and medical education as part of the NYHCRA. It’s a New York law requiring payors of health care services to contribute to public health funding through surcharges or pool payments.

Responsibilities for self-funded groups

To avoid penalties and additional fees, employers with self-funded group plans are responsible for ensuring compliance with New York, including filing required forms with the New York Office Pool of Administration (OPA) and notifying them of any changes to your insurance administrator or funding status.

How this impacts self-funded groups

A special agreement between the New York Department of Health (DOH) and Anthem Blue Cross Blue Shield (Anthem BCBS) affects the NYHCRA filing requirements for BCBSND and its self-funded groups.

These requirements go into effect when a member receives care from a New York provider that is outside of the BlueCard® network, which is the system that allows all Blue Cross Blue Shield plans to communicate, share information and handle fees/payments for the NYHCRA and the New York Public Goods Pool (NYPGP).
