Two new sets of health-related laws

In recent months, two bills were signed into law:

The Consolidated Appropriations Act, 2021
Signed into law under the Trump administration on December 27, the bill includes funding for COVID-19 relief, protections for patients from surprise medical bills and health care price cost estimates among other health-related provisions. While many clarifications remain pending, BCBSND is evaluating the mandate and refining our systems to comply.

The American Rescue Plan Act of 2021
This was signed into law on March 11 under President Biden. The $1.9 trillion funding package includes $70 billion to increase COVID-19 vaccine distribution and testing. The bill enhances the generosity of premium tax credits through 2022 for individuals with incomes above 400% of the federal poverty level and increases the generosity of the tax credits for those with incomes between 100% and 400% FPL. Individuals who are receiving unemployment assistance also qualify for zero-premium plans, regardless of family income. The bill also provides full subsidy for COBRA premiums for “assistance eligible individuals” from April 1, 2021 through September 30, 2021.
