Confidentiality of Substance Use Disorder Patient Records Rule (Part 2 Rule)

Blue Cross Blue Shield of North Dakota (BCBSND) is informing our provider community of updates to the federally mandated rule. Federally funded providers who treat or diagnose patients for substance use disorders (SUD) or refer patients for treatment of SUDs are subject to the Confidentiality of Substance Use Disorder Patient Records Rule (42 C.F.R. Part 2) as a Part 2 Program. Part 2 is intended to protect patients who are receiving Treatment for a SUD from adverse consequences of the disclosure of their records.

BCBSND Participating Providers should be aware that as of Feb. 16, 2026, Provider Group Participation Agreements will be automatically amended. Compliance with this mandate will become a condition for continued participation.

To comply with the 42 C.F.R. Part 2, Providers must obtain the appropriate consent from the patients but also to comply with this new addition to the rule.

Here is a link to the online consent form that BCBSND has offered to all providers: https://www.bcbsnd.com/content/dam/bcbsnd/documents/forms/providers/Confidentiality-of-Substance-Use-Disorder-Consent.pdf
